1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Ukodes ("we," "us," or "our"), the developer of Colorcraft, regarding your use of the Colorcraft iOS application and any related services (collectively, the "App").

By downloading, installing, or using the App, you confirm that you are at least 13 years of age (or the applicable age of digital consent in your jurisdiction), that you have the legal capacity to enter into this agreement, and that you agree to be bound by these Terms.

If you are using the App on behalf of a minor under your parental or guardian authority, you accept these Terms on behalf of that minor and take full responsibility for their use.

If you do not agree to these Terms, please do not download or use the App.

2. License to Use

Subject to your compliance with these Terms, Ukodes grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App solely for your personal, non-commercial purposes on Apple-branded devices that you own or control, and as permitted by the Usage Rules set forth in the Apple App Store Terms of Service.

This license does not include the right to:

Any use of the App not expressly permitted by these Terms is prohibited and may result in termination of this license and legal action.

3. App Content & Ownership

3.1 Ukodes Content

All coloring images, artwork, designs, illustrations, line art, color palettes, sound effects, music, interface elements, and other content provided through the App (collectively, "Ukodes Content") are owned by or licensed to Ukodes and protected by copyright, trademark, and other intellectual property laws. All rights are reserved.

Your use of the App does not transfer any ownership or intellectual property rights in Ukodes Content to you. You may not reproduce, distribute, publicly display, or create derivative works from Ukodes Content outside the App without our prior written consent.

3.2 Your Completed Colorings

When you color an image within the App, the resulting completed artwork is saved to your device via Apple's SwiftData framework and, if iCloud is enabled, to your personal iCloud account. Your completed colorings belong to you and remain under your control at all times.

Ukodes does not access, collect, or store your completed colorings on its own servers. You may save, share, or print your completed colorings for personal, non-commercial use. Commercial use of completed colorings derived from Ukodes Content (e.g., selling prints) is not permitted without a separate license agreement.

4. Subscription Terms

4.1 Available Plans

Colorcraft offers optional auto-renewing subscriptions that remove advertisements and unlock the full ad-free experience. The following subscription tiers may be available:

Current pricing is displayed in the App at the time of purchase and is subject to change as described in Section 4.6. All prices are in the local currency of your App Store region and include applicable taxes where required by law.

4.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled by you at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. The renewal fee will be the same as the original subscription price unless we have notified you of a change in advance.

4.3 Cancellation

You may cancel your subscription at any time through your Apple ID account settings:

On your iPhone or iPad: Settings → [Your Name] → Subscriptions → Colorcraft → Cancel Subscription

Cancellation takes effect at the end of the current billing period. You will retain access to subscription benefits until that date. Cancelling a subscription does not entitle you to a refund for the current period unless required by applicable law or Apple's refund policies.

4.4 Free Trials

Ukodes may from time to time offer a free trial period for new subscribers. If a free trial is offered, it will be clearly identified before you begin the subscription process, along with the price that will be charged at the end of the trial.

Unless you cancel before the free trial period ends, the subscription will automatically convert to a paid subscription and your Apple ID will be charged the applicable subscription fee. You may only use a free trial once per subscription product, per Apple ID.

4.5 Refunds

All subscription purchases are final and non-refundable, except as required by applicable law or as provided by Apple's refund policies. If you believe you are entitled to a refund, you must submit your request directly to Apple through the App Store, as Apple handles all billing and payment processing.

4.6 Price Changes

Ukodes reserves the right to change subscription prices. We will provide at least 30 days' notice of any price change through an in-app notice or notification. If you do not cancel your subscription before the price change takes effect, you consent to the new subscription price. Apple may also require you to re-confirm the new price before the renewal is processed.

5. Free Tier & Advertising

Colorcraft is available as a free download with all coloring content accessible to all users. Free users (those without an active subscription) will see advertisements served through Google AdMob within the App. Advertisements may appear on the home screen, between completed sessions, or as optional rewarded ads.

Ukodes does not control the specific content of third-party advertisements displayed through AdMob and is not responsible for the products, services, or claims made in any such advertisement. Advertisements are provided by Google's systems based on applicable targeting parameters; Ukodes is not liable for the accuracy, legality, or appropriateness of ad content.

By using the free tier, you acknowledge and consent to the display of advertisements. If you prefer an ad-free experience, you may purchase a subscription as described in Section 4.

6. Acceptable Use

You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the App. Without limitation, you agree not to:

Colorcraft is intended for personal, non-commercial use only. Any commercial exploitation of the App or its content — including but not limited to selling, reselling, or sublicensing the App — is strictly prohibited.

7. User-Generated Content

Colorcraft does not include any social features, community uploads, or mechanisms for users to share content with other users through our servers. The "content" you create — specifically, your completed colorings resulting from your use of the App — is generated locally on your device and stored in your personal iCloud account via Apple's CloudKit infrastructure.

Ukodes does not have access to your completed colorings and does not process, monitor, or store them on any Ukodes-controlled servers. Your completed colorings remain entirely within your own device and iCloud account. You retain full ownership of your personal coloring work.

When you choose to share or export a completed coloring (for example, saving to your Photos library or sharing via the iOS share sheet), such sharing occurs entirely through Apple's standard iOS mechanisms and is subject to the terms and privacy policies of the receiving platform or application.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UKODES EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law.

Your use of the App is at your sole risk. If you are dissatisfied with any portion of the App or with these Terms, your sole and exclusive remedy is to discontinue use of the App.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UKODES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO:

IN ALL CASES, UKODES'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF:

Some jurisdictions do not allow limitations on liability for certain types of damages, so some or all of the above limitations may not apply to you. In those jurisdictions, Ukodes's liability is limited to the maximum extent permitted by law.

10. Governing Law & Dispute Resolution

10.1 Governing Law

These Terms and any dispute arising out of or relating to them or your use of the App shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict-of-law principles. This choice of law does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.

10.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the App, the parties agree to first attempt to resolve the matter through good-faith negotiation. To initiate this process, please contact us at pixoduse@gmail.com describing your concern in detail. We will endeavor to respond within 15 business days and work with you to reach a mutually acceptable resolution.

If informal resolution is not achieved within 60 days of the initial written notice, either party may pursue available legal remedies. If you are a consumer in a country that requires local courts or mandatory arbitration, those provisions take precedence over this clause to the extent required by applicable law.

10.3 EU and UK Consumer Rights

If you are a consumer residing in the European Union or the United Kingdom, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr, or to bring proceedings before your local courts. Nothing in these Terms limits your rights under applicable mandatory consumer protection law.

11. Changes to These Terms

Ukodes reserves the right to modify these Terms at any time. For changes that are material — such as new restrictions on use, changes to limitation of liability, or introduction of new paid features — we will provide at least 30 days' notice by posting the updated Terms within the App or at https://pixoduse.github.io/colorcraft/terms.html, and by displaying an in-app banner or notification.

Non-material changes (such as clarifications, typo corrections, or updates to contact information) may be made without advance notice.

Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the App before the changes take effect.

We encourage you to review these Terms periodically. The "Last Updated" date at the top of this page always reflects the most recent revision.
